TERMS AND CONDITIONS
1. Introduction
1.1 This advertisers agreement (“the Agreement”) is made between Fiesta Spain Investment S.L (“OwnersAndBuyersDirect”, “We”) and the Advertiser (“You).
1.2 By entering into this agreement you are confirming you have read these Terms and Conditions and agree to them.
1.3 You agree to OwnersAndBuyersDirect publishing your advert details on our web site and the web sites of our partners.
2. Your Responsibilities
2.1 You have the legal right to sell or rent the property.
2.2 The description you supply is true and accurate and not misleading. OwnersAndBuyersDirect does not take any responsibility for the accuracy of the information supplied and cannot be held liable.
2.3 You will pay the full advert fee before the advert will be published.
2.4 You have obtained permission from the owner of any photographs used in the advert. OwnersAndBuyersDirect will not be held liable for breach of copyright.
2.5 If you have a contract with an Estate Agent, you have independently checked your contract with regards to the terms and conditions that you must pay the Estate Agents commission. If later it is found that you are legally bound to pay the Estate Agents commission, OwnersAndBuyersDirect will not be liable.
2.6 Only one property may appear in each advert.
2.7 You will assemble the ‘For Sale’ or ‘To Let’ board complying with the local planning authority regulations.
2.8 You will set your own selling price or rental price.
2.9 You will arrange and conduct viewings for the advertised property.
2.10 You will inform OwnersAndBuyersDirect once the advertised property is sold or rented.
3. OwnersAndBuyersDirect’s Responsibility
3.1 Services that fall under the until sold option will be reviewed after a year has passed from the date the service was purchased. After which OwnersAndBuyersDirect will have the right to discontinue the advert which includes the re-advertising on partner sites.
3.2 Services that fall under the until let option have purchased a slot for 1 year from the date of purchase, after which the advert will expire which includes the re-advertising on partner sites.
3.3 We will, to the best of our efforts, ensure that the OwnersAndBuyersDirect web site is available at all times. We reserve the right to take the site ‘off-line’ without prior notice for essential maintenance and upgrades.
4. Refunds
4.1 You may cancel this contract by informing Fiesta Spain Investment S.L. in writing or email within 24 hours of placing the advert.
4.2 No refund will be made after 24 hours or after you have received an enquiry in your account, whichever is first. All advertising after 24 hours is classed as ‘Free of Charge’.
4.3 Under no circumstances will our liability exceed the value of advertising fee received
4.4 This does not affect your statutory rights as a consumer.
